The Sligo/Leitrim based Fianna Fail spokesman on Transport says the system for fixed charge penalty notices is now in ‘disarray’ following a legal judgement.
Deputy Marc MacSharry is blaming Transport Minister Shane Ross for not acting quickly enough.
Earlier this week, a judge ruled that a section of the Road Traffic Act concerning fixed charge penalty notices is unconstitutional.
The judgement arose from a provision that stipulates that drivers facing a conviction for a fixed charge penalty notice cannot use non-receipt of a notice as a defence in their cases.
Deputy MacSharry says the judgement was signalled three weeks ago but Minister Ross didn’t take action to close the lacuna, or gap, in the law.
