Donegal councillor’s case appealing minister’s decision is settled



The case brought by a Donegal county councillor appealing a decision of the Minister for the Environment has been settled.

It related to a decision by the minister over-ruling restrictions placed by the county councillors on wind farm developments.

The case was brought by Independent Councillor John Campbell.

Last June councillors in Donegal voted to vary the County Development Plan in favour of restricting wind farms.

They voted to create a certain set-back distacne from residential properties and other population centres.

However, On October 3rd, Minister Alan kelly issued a direction overtuirning the councillors decision.

Cllr Campbell had argued that the minister had acted beyond his powers.

He told Ocean FM the High Court had quashed the direction of the minister and awarded him his full costs.

He says an inspector will now be appointed to examine the order the Minister made.
